Welcome to Erin Jacob Photography! I am committed to providing you with a safe and enjoyable photography workshop experience. Please carefully review the following terms and conditions before booking your workshop. By registering for a workshop, you agree to these terms.

General Information

  • Acceptance of Terms: Payment of the workshop fee confirms your acceptance of these terms and conditions.

Booking and Payment

  • Booking Process: Bookings are accepted on a first-come, first-served basis. To secure your spot, please complete the online registration form and pay the required deposit or full payment, depending on the terms of the workshop.

  • A non-refundable deposit is required to secure your booking. If the minimum number of participants is not reached, the deposit will be refunded in full. In all other cases, the deposit is non-refundable.

  • All amounts are in New Zealand Dollars.

  • Payment Method: Payments are to be made via bank transfer or credit card through my secure payment portal.

  • Full payment is due 90 days before the workshop start date. If payment is not received by this deadline, I reserve the right to cancel your booking, and any payments made may be subject to the cancellation policy outlined above.

Cancellation and Refund Policy

Cancellation by you

  • More than 60 days before the workshop: Your deposit is non-refundable. Any additional payments made beyond the deposit will be refunded, less any unrecoverable third-party costs (if applicable).

  • 60 days or less before the workshop: No refunds will be issued, and all payments made are forfeited.

  • Transfer of Booking: You may transfer your place to another suitable participant at no additional cost, subject to approval by Erin Jacob Photography. The replacement participant must complete all required forms and accept these Terms & Conditions. Any financial arrangements between parties are your responsibility.

Cancellation by Erin Jacob Photography

If the workshop is cancelled due to insufficient bookings, illness, extreme weather, venue issues, government restrictions, or other circumstances beyond reasonable control, you will be offered:

  • A full refund of all payments made, or

  • The option to transfer your booking to a future workshop.

Erin Jacob Photography is not responsible for any additional costs incurred, including but not limited to flights, accommodation, transport, insurance, or equipment hire. Travel insurance is strongly recommended.

Accommodation Sharing Clause

Since guests share a two-bedroom chalet, include:

Accommodation is provided on a shared basis, with each participant having a private bedroom and ensuite within a two-bedroom chalet shared with one other participant. Erin Jacob Photography will allocate chalet pairings by gender.

Force Majeure

  • I am not liable for any cancellations, delays, or changes to the workshop due to events beyond my control, including but not limited to weather, natural disasters, pandemics, government restrictions, or any other unforeseeable event.

  • Postponement: In the event that the workshop is postponed due to force majeure, any payments made will be credited toward a future workshop.

  • Cancellation: If I am forced to cancel a workshop due to force majeure, you will be offered a full refund or the option to transfer to another workshop.

Insurance

  • Travel Insurance: it is strongly recommend that you obtain travel insurance to cover any cancellations, delays, medical emergencies, or loss or damage of personal items during the workshop.

  • Personal Injury & Health Insurance: It is your responsibility to ensure you have appropriate insurance for your health and safety.

  • Liability for Equipment: Erin Jacob Photography is not responsible for any damage, theft, or loss of personal equipment or belongings.

  • As the cancellation policy will apply in all circumstances, I strongly recommend that your travel insurance provides adequate cover for cancellations, delays, and any unforeseen changes to your plans.

  • It is your responsibility to ensure your policy provides appropriate cover.

Itinerary Changes

  • Changes to Itinerary: I reserve the right to modify the itinerary if necessary, due to weather conditions, equipment failure, or any other reason beyond my control. Any significant changes will be communicated to you as soon as possible.

  • Photography Conditions: Landscape photography is dependent on numerous factors, including but not limited to weather and light conditions. I cannot guarantee specific photography opportunities.

Fitness, Health, and Behaviour

  • Fitness Level: My workshops are designed for participants that are in good health and moderate level of fitness. However, some workshops may involve walking, hiking, on uneven ground in wilderness or alpine areas.

  • Participants must carry their own gear, including camera equipment, extra clothing, food and water.

  • Health Disclosure: You must inform me of any health conditions or medical concerns that could affect your participation in the workshop. Failure to disclose such information may result in risks to your safety or ability to participate fully.

  • Limitation of Liability: Erin Jacob Photography is not liable for any injury, illness, or other consequences arising from your failure to disclose relevant health conditions.

  • Behaviour: Inappropriate behaviour, including harassment or disrupting the experience for others, will not be tolerated. I reserve the right to remove any participant from the workshop without a refund if their behaviour is deemed unacceptable.

Waiver of Liability

  • Assumption of Risk: By attending the workshop, you voluntarily assume all risks associated with outdoor photography and travel, including injury, illness, loss of property, or death.

  • By attending this workshop, you acknowledge and accept that Erin Jacob Photography, its owner (Erin Jacob), and any affiliated service providers are not liable for any personal injury, loss, damage, or expenses incurred during the workshop. You voluntarily assume all risks associated with outdoor photography and travel and release Erin Jacob Photography from any claims arising from your participation.

Promotions and Media Use

  • Media Consent: During the workshop, photographs and videos may be taken, including images of participants. By attending, you consent to the use of these images in promotional materials, including on my website and social media platforms. If you do not wish to be photographed, please inform me before the workshop.

  • Use of Testimonials: I may use testimonials provided by participants for promotional purposes. If you do not wish your testimonial to be used, please let me know in writing.

Privacy Policy

  • Personal Information: I collect and store personal information necessary to facilitate your booking, including your name, contact details, and payment information. I will only use your information for the purpose of running the workshop and maintaining my relationship with you.

  • Data Protection: I am committed to keeping your information secure. Your personal details will not be shared with third parties without your consent, except where required by law.

Miscellaneous

  • Amendments: Erin Jacob Photography reserves the right to amend these terms and conditions at any time. Any changes will be communicated to participants.

  • Governing Law: These terms and conditions are governed by the laws of New Zealand.

By booking a workshop with Erin Jacob Photography, you confirm that you have read, understood, and agreed to these terms and conditions.
